The Data Act

The Data Act (Regulation (EU) 2023/2854) addresses several challenges and opportunities presented by data in the European Union (EU), emphasising fair access and user rights, while ensuring that personal data is protected.

The main aims of the Data Act include:

  • Stimulating a competitive data market
  • Enabling new possibilities for innovation through the use of data
  • Making data, in particular data generated by connected products, more accessible

Accordingly, it introduces provisions that grant users of connected devices (including smartphones, smart home appliances, and intelligent industrial machines), the right to access the data generated through their usage.

The regulation entered into force on 11th January 2024 and became applicable as of 12th September 2025.

The MDIA is designated as the Competent Authority responsible for the application and enforcement of all the provisions of the Data Act, with the exception of the Articles 23 – 31 and Articles 34 – 35.

Furthermore, the MDIA is the Data Coordinator to facilitate cooperation between the competent authorities and to assist entities within the scope of the Data Act on all matters related to its application and enforcement.

The Malta Communications Authority (MCA) is designated as the Competent Authority responsible for the application and enforcement of Articles 23 – 31 and Articles 34 – 35.

The Information and Data Protection Commissioner (IDPC) is the Competent Authority responsible for monitoring the application of the Data Act, insofar as the protection of personal data is concerned.
