The first legally binding international agreement on Artificial Intelligence (A) was signed on 5th September 2024 by a number of countries, with the aim to protect human rights, democracy and the rule of law when AI systems are used.
Among the countries that negotiated this Convention, there were the 46 Council of Europe Member States, the European Union, including Malta, and 11 non-Member States, such as Japan, Canada and the United States of America. Civil Society and the private sector also participated as observers. Following this, the Council of Europe Committee of Ministers adopted the Convention on 17th May 2024.
Experts from the MDIA represented Malta in the negotiations and is also working with all stakeholders to facilitate effective implementation.
While the Framework Convention establishes principles and rules to ensure that activities within the lifecycle of AI systems, both in the public and private sector, are fully consistent with human rights, democracy and the rule of law, this Convention leaves it up to the parties on the method used to adhere to the Convention.
The next step is for the CAI to start the necessary negotiations on the non-binding Human Rights, Democracy and the Rule of Law Impact Assessment (HUDERIA), of which meetings will commence 17th September 2024.
