Certified Dispute Settlement Bodies

In accordance with Article 10 of Regulation (EU) 2023/2854 (Data Act), the MDIA, in its capacity as one of Malta’s designated Competent Authority, certifies Dispute Settlement Bodies, established in Malta as empowered by Subsidiary Legislation 591.04, Article 3.

Certified Dispute Settlement Bodies provide independent, impartial and transparent dispute resolution services for disputes arising under the Data Act, including those relating to data access, data sharing, and fair, reasonable and non-discriminatory terms and conditions.

Certified Dispute Settlement Bodies address disputes arising from the Data Act including:

  • Disagreements over Fair, Reasonable, and Non-Discriminatory (FRAND) data-sharing terms and compensation.
  • Disputes concerning the refusal or restriction of data access (such as trade secret protections).
  • Conflicts between cloud service providers and customers over customer rights and provider obligations.

Certified Dispute Settlement Bodies shall deliver a written decision with a statement of reasons within 90 days of receiving a request. Such decisions are not automatically binding, unless both parties explicitly agree to adopt the decision as binding before proceedings start.
