Technical Experts Natural Person

A Technical Expert Natural Person (TENP) is an individual recognised by the Malta Digital Innovation Authority (MDIA) who possesses the required knowledge, qualifications, and experience in a particular innovative technology domain.

Recognised TENPs may be engaged to perform roles in initiatives, programmes, or schemes issued by the MDIA or other relevant entities.

Such roles may include, but are not limited to:

• Conducting technical evaluations
• Performing technical reviews
• Providing specialised technical expertise

Individuals who meet the eligibility requirements outlined in the TENP Guidelines may apply.

Applicants must demonstrate:

• Relevant qualifications or technical experience in innovative technology or auditing
• Technical merit in the relevant field
• Good conduct and fit and proper status
• Knowledge of relevant technologies, standards, laws, and guidelines

Additional requirements may apply depending on the initiative, programme, or scheme in which the TENP may be engaged

Applicants are required to complete the TENP Application Form and submit the necessary documentation.

The application may include, but is not limited to, the following documents:

• Proof of Identification
• Proof of Address
• Police Conduct Certificate
• Certificates demonstrating relevant qualifications and experience
• Curriculum Vitae (CV)

The MDIA may also request additional documentation or clarification during the evaluation process.

The MDIA may require applicants to undertake an assessment or interview to verify their knowledge, expertise, and understanding of relevant technologies and processes.

Such interviews or assessments may be conducted remotely or in person, at the discretion of the Authority.

These requests are made at the discretion of the Authority as part of the evaluation process.

Applicants will be informed in writing of the outcome of their application once the evaluation process has been completed.

If successful, the applicant will receive an Acceptance Letter confirming recognition as a TENP.

Recognition as a Technical Expert Natural Person is granted for a maximum period of three (3) years from the date of the Acceptance Letter issued by the MDIA, unless revoked, suspended, or terminated earlier in accordance with the TENP Guidelines.

Yes.

A recognised TENP who wishes to renew their recognition must submit a request for renewal at least three (3) months before the expiration of the current recognition term, together with any documentation requested by the MDIA.

The MDIA may maintain and publish a Register of recognised TENPs on its website.

The register may include:

• Name and surname
• Contact details
• Approved domain(s) of expertise
• Professional portrait (if provided)

This allows third parties to identify recognised TENPs and their areas of expertise.

Recognised TENPs must comply with the obligations outlined in the TENP Guidelines, including:

• Acting with professional integrity and competence
• Maintaining impartiality and independence
• Complying with confidentiality and data protection requirements
• Informing the MDIA of any changes in qualifications, skills, or circumstances
• Cooperating with audits or assessments conducted by the Authority

Impartiality means that conflicts of interest do not exist or are properly managed, so that they do not influence the activities or judgement of the TENP.

Concepts associated with impartiality include:

• Independence
• Honesty
• Objectivity
• Freedom from conflicts of interest
• Neutrality
• Fairness
• Open-mindedness
• Balance

Recognised TENPs must ensure that their professional judgement is not influenced by commercial, financial, or other pressures.

TENPs must ensure that their activities remain independent and free from undue influence.

This includes:

• Identifying and managing risks to impartiality on an ongoing basis
• Avoiding situations that may create conflicts of interest
• Not allowing commercial or financial interests to influence their work

Examples of risks to impartiality may include:

• Working relationships
• Financial interests or ownership
• Shared resources or personnel
• Contractual arrangements or commissions for referrals

Where such risks arise, TENPs must demonstrate how they are eliminated or sufficiently mitigated work, consanguinity or because of any liens, loans; and other facility with such target companies.
